Teacher Charged With E-Mailing Topless Photos To Student


She's being called the topless teacher.

A 27 year old Chesterfield woman who taught at a newly opened, private St. Charles County high school is facing a criminal charge for allegedly e-mailing topless pictures of herself to one of her students!

The former teacher, Melissa Moss, was fired from her job as an English teacher at the Barat Academy in Dardenne Prairie after the investigation began in November.

Court documents say in mid-November, Moss e-mailed two pictures of herself nude from the waist up to a 15 year old boy in her class.

School officials say the parents of the teen found the pictures while patrolling his internet activity and went to police as well as the school.

A profile has come up on Facebook.com supporting Moss- people posting messages including we want her back at Barat Academy.

We talked with the Robert and Kelly Pfeiffer- their son was in Moss' class.

They say they thought she was a great teacher and they're stunned by the charges.

"It is very disturbing and you know it's kind of a sign of the times the way we live with a lot of internet access and Face book and things like that. As a parent you have to be on constant vigil to make sure, you have to know what your kids are getting into," said Robert Pfeiffer.

His wife, Kelly, added, "I was kind of shocked because I worked with her a lot as far as one on one talking to her you know about his grades and keeping up with them and I thought she was a really nice teacher. So when this came about, it really shocked me."

Barat Academy is a private, independent catholic high school that opened last September.

The school's president, Debby Watson, said of the situation, "it's frustrating, it's upsetting, it's disappointing. It's all of those emotions. But what I'm most proud of is that parents did the job they needed to do. And they work in partnership with the school."

The school sent letters home to parents alerting them to what was happening back in November when the investigation was just beginning.

Officials at Barat say Moss did not use school systems to send the pictures.

The charge against her is a class A misdemeanor- she could face up to a year in jail and a one thousand dollar fine.

Arizona bill fills gap on teacher sex crime alerts

A Chandler lawmaker has proposed a state law that aims to fill a gap in a state notification system that allowed a kindergarten teacher accused of child sex crimes to lead class for more than six months without the school knowing.

Rep. Bob Robson, R-Chandler, introduced HB2042 on Feb. 21 after reading two Tribune reports about Angela Csader, a 25-year-old Queen Creek resident who resigned from her job at Anthem Elementary in Florence last month after she was charged with having sex with a 16-year-old Gilbert boy.

The bill calls for an immediate and streamlined notification system between law enforcement and schools to prevent cases such as Csader's from happening again.

"You could see that there was a drop in the system, and we needed to close those holes," Robson said.

Police learned of Csader's situation more than a year before her resignation, and she admitted to Gilbert police in May that she had sex multiple times with the boy, who also fathered her child.

But the boy and his parents never pressed charges, records show. That decision delayed the arrest and booking process - and revealed a gap in the notification process.

Police: former Flagstaff teacher had sex with former students


Flagstaff police are recommending charges against a woman who once taught at Flagstaff High School. 29 year old Tawni Wimberley is accused of having sex with multiple teenagers including a 17 year old boy.

Police say their investigation began after hearing rumors of alleged teacher-student sex.

Officers say multiple former students admitted to having sex with their former teacher. Two students were 18 but police say one male student was underage. Wimberley taught at Flagstaff High School for five years. She has not taught this school year. Wimberley has not been arrested or charged but police have sent a report to the Coconino County Attorney recommending one felony charge. Police say she had sex with one of the 18 year old former students at Flagstaff High School during the summer.

The Flagstaff Unified School District says they did a background check on Wimberley before hiring her.

Stephanie Stein seeks to do less time in sex case


A former teacher at Plymouth Christian Academy accused of having sex with a 15-year-old boy is expected to ask a Wayne County judge this morning to deviate from state sentencing guidelines and give her a lighter sentence if she pleads guilty.

Stephanie A. Stein, 32, of Canton has been charged with two counts of third-degree criminal sexual conduct, one count of using the Internet to communicate with another to commit a crime, and one count of distributing obscene material to a child.

She denies having sex with the boy, who had been her student.

Under state sentencing guidelines, if she pleads guilty to all four charges, she could be sentenced to between 4 years and 9 months to almost 8 years years on the minimum range, and up to 15 years at maximum.

Her attorney, Todd Flood, has submitted a request for a Cobbs evaluation, in which a judge will be asked to calculate a probable sentence in light of her personal circumstances.

Flood wrote that Stein has no criminal history, poses no future threat of offending, has two young children depending on her, has an exemplary work and educational history and has overwhelming support from her family.

Stein said she believes her sentencing range should be 2 1/2 years to 4 years and 2 months, Flood wrote.

Wayne County Assistant Prosecutor Lora Weingarden opposes a lighter sentence.

Stein was offered a deal in which she would plead guilty to one count of third-degree criminal sexual conduct and 30 months to 15 years. But "she rejected it so it was off the table," Weingarden said.

Stein and the boy began a relationship in January 2007 that ended in September. On Sept. 28, the boy testified at a preliminary examination that he and Stein had sex during the summer at his home, at Stein's mother's home and at a hotel. Stein also sent a nude photo of herself to the boy, investigators said.

"Ms. Stein's actions were motivated by physical, emotional and psychological pain rather than a desire to do something illegal," Flood wrote, citing a therapist's evaluation.

Circuit Court Judge David Groner will hear the case.

Family of Rachel Holt's Victim Sues Delaware School District


Dover, Del. (AP)- The family of a 15-year-old Wilmington boy who was raped by his Brandywine School District teacher filed a lawsuit against the school board on Wednesday.

Also named as defendants in the New Castle County Superior Court lawsuit are former Brandywine superintendent Bruce Harter and the victim's former teacher, Rachel L. Holt, who is serving a 10-year prison sentence.

The lawsuit claims that the school district failed to do a proper background check when hiring Holt, 36, who had been employed at four different schools in five years before being hired as a sixth-grade science teacher at Claymont Elementary School.


The lawsuit also alleges that school officials had received several reports about inappropriate conduct by Holt in the months preceding her arrest in April 2006. The alleged conduct included kissing students, sitting on their laps in the classroom, and dancing on classroom tables.


"The district recklessly ignored these reports of misbehavior and failed to warn parents or students of the dangers Holt posed, in disregard for the obvious risks of harm to any child who came into contact with her," said Thomas Neuberger, a lawyer representing the family of the victim, who was 13 at the time.


Ellen Marie Cooper, a staff attorney for Brandywine School District, said she had not seen the complaint and could not comment on it.


Last month, district officials settled a Chancery Court lawsuit filed by a former guidance counselor who claimed that she was fired after alerting the Claymont school principal to Holt's inappropriate conduct. District officials have refused to release the amount of the settlement with Mary Ann Giannotti, who claimed she was fired in retaliation for comments that raised the appearance of possible negligence by school and district officials in failing to protect students from Holt.


According to investigators, Holt had sex with the boy 28 times in one week, and on at least one occasion allowed the boy's 12-year-old friend to watch.

Authorities also said she gave the students alcohol.
Authorities said the boy's father contacted them after becoming suspicious that his son was having an inappropriate relationship with his teacher, who had taken the boy out for dinner and allowed him to drive her vehicle.

Holt was charged with 28 counts of first-degree rape. She pleaded guilty to one count of second-degree rape and was sentenced in March 2007 to 10 years in prison.

Teacher's Aide Quits After Hosting Sex and Drugs Party for Students

A special-education aide at Highlands Senior High School resigned under pressure yesterday and faces possible drug and corruption of minors charges for a hotel party involving high school teenagers.

New Kensington police said they found suspected crack cocaine, empty beer cans and used condoms in a room that Abbiejane Swogger, 34, of Harrison, shared with minors Thursday night at New Kensington's Clarion Hotel. The room contained drug paraphernalia and a marijuana odor when officers arrived just before noon on Friday to follow up on reports of missing teens, said Detective Dennis Marsili.

Investigators questioned Ms. Swogger at the New Kensington police station Friday afternoon, but did not arrest her. Charges could be filed as soon as today, Detective Marsili said.

He said police would consult with the Westmoreland County district attorney's office about whether there's a basis for charges of possession of controlled substances and corruption of minors against Ms. Swogger, and whether any charges should be filed against others involved.

Ms. Swogger was in the hotel lobby when police from New Kensington, Harrison and Tarentum arrived, Detective Marsili said. Two female juveniles from Harrison and Tarentum whose relatives had contacted police after they failed to come home Thursday night were in the room, along with three males.

The police investigation did not factor into action taken against Ms. Swogger yesterday morning by Highlands School District officials, according to Superintendent Karol Galcik. She said Ms. Swogger failed to report for work, without explanation, either Thursday or Friday. A letter was sent to her Friday about her conduct, Dr. Galcik said, advising her to meet with administrative representatives yesterday.

"She did not follow proper procedures in not showing up for work," the superintendent said after yesterday's meeting. "We said that she had a choice to either resign or we would be taking this to the school board [for possible dismissal], and she chose to resign at that time."

The one-time exotic dancer worked since September for the school district at a job paying minimum wage or slightly above. At the time Ms. Swogger was hired, the school district had no drug-testing policy for employees at her level, Dr. Galcik said. The school board later expanded its policy to require such testing in January for new employees, she said.

Ms. Swogger says she rented a hotel room to socialize and drink beer with adult acquaintances, but teenage friends of her son showed up and refused to leave. She maintained yesterday that she knew nothing about drugs in the room and did not give the teens any beer.

"I think if they drank, I would have known about it," she said, adding that she unsuccessfully urged the two girls to leave.

Ms. Swogger also said she did not have sex with any of the young people present. They may have had sex with one another, she said, but did so "discreetly."

She said she was upset to lose her job providing one-on-one personal-needs assistance for a disabled student: "I loved it. I loved the little girl I worked with."

She said she relied on her school income along with child support payments and Social Security checks sent to her on behalf of one of her two sons, whose father died. Her older son, a 10th-grader at Highlands Senior High School, was distraught about the attention her case has received and will transfer to a cyber school, she said.

Missouri House approves bill cracking down on teacher sex abuse

JEFFERSON CITY, Mo. -- Teachers accused of sexually abusing students could face greater scrutiny when they try to switch schools under legislation given preliminary approval Tuesday by the House.

The measure would require prompt reporting of sex abuse allegations to the state, and mandate those records be retained -- even if they aren't proven true.

It also would require school districts to adopt policies on staff and student communications and how schools communicate with each other about former employees.

The legislation was sparked by an investigation by The Associated Press that found 87 licensed teachers in Missouri lost their credentials from 2001 through 2005 because of sexual misconduct. Some continued working in other school districts after allegations arose.

To make that less likely, the legislation protects whistle blowers by barring lawsuits against school district employees who tell about sexual abuse allegations when a new district seeks to hire an employee from the old district.

When a school employee abuses a student, the legislation allows the victim and school district to sue if a previous school district had fired the perpetrator for sexual abuse and didn't disclose it.

Rep. Jane Cunningham said "passing the trash" or "mobile molesters" has been common as problem teachers move from one school district to school district.

"We have an epidemic," said Cunningham, R-Chesterfied.

Jennifer Dorland sentencing in sex assault delayed

The sentencing of Cornwall-area teacher Jennifer Dorland was adjourned Monday after a psychological report had not been completed.

Mrs. Dorland, 42, was found guilty on Dec. 20 of sexual assault, sexual interference and invitation to sexual touching on a then 13-year-old male student in 2004.

The matter is expected to be back before the court on Mar. 20 when a new date for sentencing will be set.

Jodi Church will serve four and a half years


A former special education teacher for Manual High School admits she had sex with a student and pleaded guilty to state charges today.


Jodi Church will serve four-and-a-half years behind bars, concurrent with a separate seven-year sentence for sexual solicitation over the Internet that she was sentenced last week in federal court.

Today she was sentenced for having a sexual relationship with one of her students.

Her attorney, Mark Wertz, said, "It gave her the opportunity to take responsibility which is what she wanted to do and also gives her the opportunity to pay her debt to society, but also to lead a full life when she's relseased."

Wertz says the victim and his mother did not want to press charges against Church in the most recent case.

He worked with state and federal prosecutors to reach plea agreements in both cases.

Peoria County States Attorney Kevin Lyons said, "I think the message is the same whether it's a seven-year prison sentence up the street or a four and a half concurrent here. That is, if you play the risk and get caught there's a serious consequence to that so I'm pleased with what the judge did today."

She will spend her time at a Texas Federal prison and will remain under court supervision for life when she's finished serving her prison sentence.

Massachusetts bill would criminalize sex between teachers, students

Stop messing with innocent children for God's sakes!


BOSTON — Carol Adler was just 16 when her high school English teacher first started
making advances. Ms. Adler said those moves turned sexual during her junior year, after her father died and she was most vulnerable.

For the next two years, Ms. Adler said she and the teacher continued the affair, even though he was more than a decade her senior and married with two small children. Ms. Adler said the relationship filled her with remorse and a guilt that lingered into her adulthood.

"I was derailed," said Ms. Adler, now 49 and a mother of three. "It wasn't until my children got to that age that I looked back and said, 'My God, that was why I had such a difficult time.'"

Ms. Adler, who now lives in Mattapoisett, only recently reported the relationship to school officials in Quincy, where she attended high school.

Now Ms. Adler is pushing a bill that would make sexual intercourse between teachers and students under 18 a criminal offense, regardless of consent. The bill is slated to come up for a public hearing at the Statehouse today.

While sex between adults and anyone under the age of 16 is already covered by statutory rape laws, there is no criminal prohibition on teachers engaging in consensual sexual relations with students 16 or over.

Sen. Mark Montigny, D-New Bedford, the bill's sponsor, said that although sex with a student can cost a teacher his or her job, the possibility of jail time would add another layer of protection for students.

"There's nothing clearer than a deep, thick line that says if you break this line you will be held criminally liable," said Sen. Montigny.

The proposed legislation would protect students who, while older than the age of consent, are still young enough to be taken advantage of by an older teacher, according to Sen. Montigny.

"The loophole exists at that very vulnerable age where you're just beyond where you're considered a minor, but you're still clearly under the control — and on the losing end — of the power dynamic," he said.

The dynamic that exists between a teacher and a student negates consent regardless of the age of the student, according to Sen. Montigny.

"There is no consent between a teacher and student," he said. "In the teaching environment, there is never an excuse for that type of abuse."

Michael Shea, superintendent-director of Greater New Bedford Regional Vocational-Technical School, said a sexual relationship with a student would be grounds for automatic dismissal of a teacher in most school districts.

Layering a criminal penalty on top of the dismissal makes sense if the student involved is under 18, he said.

"It doesn't matter how old the student is," said Mr. Shea. "A student is a student, and a teacher is a teacher. I would support (the legislation), because I still think students at 17, 17½ are not at that point to make that decision."

Female sex predators hard to understand

Schoolboys may have always harbored crushes on attractive teachers, but experts say more than ever before, flirtations between boys and women are developing into sexual affairs that lead to criminal charges, convictions and jail time.

This month, Friendswood police arrested a 26-year-old private school teacher on charges that she had sex with a 17-year-old student along a deserted road.

Days before, a 29-year-old Galveston City Hall worker was charged with sexually assaulting of 13-year-old boy who was a longtime friend of her stepson.

Within the same week, a Deer Park High School teacher was charged with having sex with a teenage student.

None of these woman have been convicted of any crimes.

Getting Brazen

Although experts agree there’s a noticeable spike in the number of women arrested for sexually assaulting minors, explanations for that increase differ.

One explanation offered by California law activist Bonnie Russell, is that older women used to be more discreet in their sexual pursuits and have become more open.

“Male sex offenders have always been brazen,” she said. “Females doing this, or at least getting caught, used to be very uncommon. Now they’re getting brazen, flaunting obvious law-breaking.”

Or perhaps, as licensed psychotherapist Tina Tessina suspects, the crimes are just being reported more.

“Police would laugh at you 30 years ago if you reported a teenage boy being victimized by his teacher,” Tessina said. “Police departments have gotten much more aware and now, a lot of people are mandated to report this.”

The allure of attractive teachers has always been there for students, Tessina said.

But it’s the older person who has the responsibility to stop the flirtation.

“She’s the one who’s supposed to put the breaks on it,” Tessina said. “Instead, she remains passive and keeps the whole thing going. Eventually, she might get aggressive. Obviously, she’s not thinking rationally.”

Sexual relationships between women and underage boys, whether becoming more common or not, shock many people more than news of men assaulting young girls because it’s against the stereotype, said Frederic Reamer, a sociology professor at Rhode Island College and a member of that state’s parole board.

“This pattern is so far outside the box that we ordinarily live in, we can’t help but be alarmed by this,” he said. “This scenario has the capacity to shock the conscious and we struggle to understand.”

Mixed Motives

Female sex offenders are less prevalent than their male counterparts, which is one reason why research into women sexual crimes has been largely overlooked until recently, Seattle University criminology professor Elaine Gunnison said.

“In the past, society tended to accept the fact that males were committing sexual offenses against young girls,” she said.

“More recently, the public is becoming aware of the fact that women, despite their feminine demeanors, can be sexual predators.”

Understanding the motives of well-educated women who enter into a sexual relationship with young boys isn’t easy because no cases are exactly alike, Reamer said.

“You take 100 different offenders, and they’ll have 52 different motives,” he said.

Overall, experts agreed that women who pursue underage boys for sex are often emotionally immature, lonely and can be trying to relive their youths.

“I don’t think teachers set out to find students and lure them,” said therapist Debbie Mandel. “It starts subliminally and the attraction becomes overpowering.

“When you’re looking at a certain age group of young teachers, you’re absolutely finding that the teacher is not mature in that sense. It’s like ‘let me do this again. I want to go back to the past and make it better. I wasn’t popular and I didn’t have the confidence then and now I do.’”

Mandel said the relationships can also be a power-grab for the older women.

“The younger man adores her,” she said. “She becomes very attractive to him. She molds him. She shapes him into what she needs.”

But in cases like the two recent Galveston County arrests, the women are rarely pedophiles, Reamer said.

Instead, the women are mentally close in age to their victim and rationalize their pursuit.

“In her mind, she’s relating to a guy her age,” he said. “Developmentally, they are much younger. They got stuck in older teenage years.”

Reamer said it’s important for parents to notice who their children spend time with. When it’s unusually long amounts of time with teachers or other adults, parents should intervene on their child’s behalf when teenagers aren’t able to stop themselves.

“It’s almost like a moth to a flame,” he said. “He is almost titillated by it. It’s like ‘Oh my gosh, look who is into me.’”
